NOTICE OF TRUSTEE 'S SALE The following property will be sold at
public auction to the highest bidder on the 23rd day of December, 2009
at 11:00 a.m. at the Main Entrance of the First Judicial District
Court at 135 North 100 West, Logan, UT 84321, County of Cache, by
CACHE TITLE COMPANY as TRUSTEE , under a Deed of Trust made by TODD
LEE HODGES, TRUSTOR(S) and recorded on March 27, 2007, as Entry No.
939919, in Book 1454, at Page 1299, in the office of the Recorder of
Cache County, Utah, given to secure an indebtedness in favor of CACHE
VALLEY BANK, records of Cache County, Utah, and by reason of breach of
obligations secured thereby, a Notice of Default was recorded on
August 21, 2009, as Entry No. 1005418, in Book 1588, at Page 871, of
said official records. Trustee will sell at public auction to the
highest bidder for cash, payable in lawful money of the United States
of America at the time of sale, without warranty as to title,
possession or encumbrances, the following described property in the
County of CACHE, State of Utah for the purpose of foreclosing a Deed
of Trust executed by TODD LEE HODGES, TRUSTOR(S), in favor of CACHE
VALLEY BANK, BENEFICIARY covering the following real property
purported to be located in Cache County at Approx. 10200 North 4800
West, Trenton, UT 84338 (the undersigned disclaims liability for any
error in the address) and more particularly described as follows:
Beginning 1 rod South and 80 rods West of the Northeast corner of the
Southeast quarter of Section 28, Township 14 North, Range 1 West of
the Salt Lake Base and Meridian, and thence West to the East line of
the West Cache Canal; thence Southeasterly along said canal to the
North line of a county road; thence East along said road to a point
South of beginning; thence North to beginning. Tax Parcel No.
14-040-0007 Beginning 1 rod South of the Northeast corner of the
Southeast quarter of Section 28, Township 14 North, Range 1 West of
the Salt Lake Base and Meridian, and running thence West 80 rods;
thence South to the North line of a county road; thence East along
said road to a point 466.69 feet West of the West line of a highway;
thence North 466.69 feet; thence East 466.69 feet to the West line of
a county road; thence North along highway to point of beginning. Tax
Parcel No. 14-040-0008 Beginning 2 rods North and 2 rods West of the
Southeast corner of Section 28, Township 14 North, Range 1 West of the
Salt Lake Base and Meridian being the intersection of 2 county roads
and thence North 466.69 feet along the West line of said road; thence
West 466.69 feet; thence South 466.69 feet, more or less, to the North
line of a county road; thence East in said North line 466.69 feet to
beginning. Tax Parcel No. 14-040-0011 TOGETHER WITH an Easement
recorded September 15, 1981 in the office of the Recorder of CACHE
County as Entry Number 446378 in Book 291 at Page 813. For the purpose
of paying obligations secured by said Deed of Trust including fees,
charges and expenses of Trustee, advances if any, under the terms of
said Deed of Trust, interest thereon and the unpaid principal of the
note secured by said Deed of Trust, with interest thereon as in said
Note and by law provided. Together with all the improvements now or
hereafter erected on the property, and all easements, appurtenances,
and fixtures now or hereafter a part of the property. The sale is
subject to a bankruptcy filing, a payoff, a reinstatement or any other
condition of which the trustee is not aware that would cause the
cancellation of the sale. If any such condition exists, that sale
shall be void, the successful bidder 's funds returned and the trustee
and current beneficiary shall not be liable to the successful bidder
for any damage. Bidders must tender to the Trustee a $5,000.00 deposit
in the form of a cashier 's check at the sale and the balance of the
purchase price by 12:00 noon the day following the sale. The balance
must be in the form of a wire transfer, cashier 's check or certified
funds payable to CACHE TITLE COMPANY, TRUSTEE. Cash payments are not
accepted. A Trustee 's Deed will be delivered to the successful bidder
